San Joaquin County Superior has a permissive eFiling system. However, One Legal does not integrate with San Joaquin County's eFiling system.
What this means for One Legal clients:
- One Legal provides physical court filing only in San Joaquin (printed documents delivered to the courthouse).
- Pricing will reflect the costs associated with physical printing, delivery, and filing.
- All requirements below relate to physical filing.
Physical Court Filing
Physical court filing is available through One Legal at all San Joaquin County courthouses. See the Court Service Availability tool for full details.
To the greatest extent feasible, documents are filed at the clerk's window. Any applicable court filing fees are paid up front by the court running on your behalf and added to your invoice.
Court-stamped copies are collected, scanned, and returned to you via your One Legal account as soon as possible.
Filings must be received by 12PM PT for same-day service in Stockton and for next-day service in Lodi and Manteca.
Courtesy Copies
San Joaquin County Requirement: Courtesy copies are required for (whether filed physically or electronically) for:
- All substantive motions
- All trial documents
- Additionally on a case-by-case basis per the assigned judge's request
Consequences for Non-Compliance
Failure to provide courtesy copies as directed may result in:
- Matter being continued on the Court's own motion to allow time to provide courtesy copies
- Imposition of monetary sanctions
- Other sanctions allowed by law for violation of Court's Local Rules (CCP Sections 128, 575.1)
Scheduling Motions
Motions are heard Tuesdays through Fridays (except when Tuesday is the first court day of the week) at 9:00 a.m.
When filing moving papers: Have at least five (5) dates (within the proper time provisions) for the clerk to check for availability.
Proof of Service: Must be on file with the Superior Court Clerk's office prior to the scheduled hearing.
Tentative Rulings System (Stockton and Lodi)
Stockton Courthouse:
- Tentative rulings posted electronically by 1:30 p.m. the day before hearing
- View at: Tentative Rulings page
- If tentative ruling is satisfactory, no appearance needed (ruling becomes final)
- To contest: Email Civil Court Clerks by 4:00 p.m. day before hearing, and notify opposing counsel/parties
- Email must include: Department, Case Number, Case Name, Motion, party's name and email, date/time of hearing, issues to argue, and confirmation that opposing party was notified
Lodi Branch: Same procedure applies. Contact court at (209) 992-5522.
Cover Sheets and Addendums
San Joaquin County Superior Court does not require special local cover sheets or addendums beyond standard Judicial Council forms for general civil matters.
Standard Requirements:
- Use standard Judicial Council forms (e.g., CM-010 Civil Case Cover Sheet)
- Follow statewide California Rules of Court requirements
Note: The court does have specific confidential cover sheets for probate matters (e.g., Trust Documents Cover Sheet SJPR-100, Financial Documents Cover Sheet SJPR-007), but these are for specialized probate filings.
Sealed and Confidential Documents
Local rules do not specify court-specific procedures for sealed and confidential documents in general civil cases beyond what is required by California Rules of Court (rules 2.550-2.551).
Probate-Specific Requirements: The court has specific procedures for confidential documents in probate matters, including use of mandatory local forms:
- Confidential Trust Documents Cover Sheet (SJPR-100)
- Financial Documents Cover Sheet (SJPR-007)
