A court fee waiver allows eligible filers to ask a California superior court to waive certain court fees because they cannot afford to pay them. A court fee waiver does not cover every service or charge.

How do I request a court fee waiver?

Complete Request to Waive Court Fees (Form FW-001) and submit it to the court following its filing requirements.

You may qualify if you receive certain public benefits, meet the household income requirements, or cannot afford court fees after paying for basic household needs. The court determines eligibility.

Submitting FW-001 does not mean your request has been approved. The court issues Order on Court Fee Waiver (Form FW-003) explaining its decision. Review the order to confirm whether your request was granted and which fees are waived.

Which One Legal fees are waived?

As a courtesy, One Legal waives its eFiling and eService fees only for orders covered by a court-approved fee waiver.

The waiver does not cover One Legal’s physical services, including:

• Courtesy copy delivery.
• Process serving.
• Physical court filing.

Standard One Legal service fees apply to these services and any other One Legal service offered that is not an efiling and eserve order, even if the court has approved your fee waiver.

How do I indicate an existing fee waiver?

The filer is responsible for selecting or indicating the existing court-approved fee waiver when placing each applicable order.

The location of the fee-waiver option varies depending on the court’s order workflow. Review the available options carefully as you complete your order.

One Legal does not automatically know that you have an approved fee waiver and cannot identify it unless you indicate it during the order process. A copy of the court-approved fee-waiver order is required for One Legal to honor the waiver of its applicable service fees.

What if fees still appear before I submit?

If you have a court-approved fee waiver but fees you expect to be waived still appear on the order review screen, do not submit the order. Confirm that you selected the appropriate fee-waiver option and contact One Legal Support for assistance.

Keep your approved FW-003 available so we can review it. Fees for physical services will still apply.
